告訴人再告訴補充理由狀故意不實指控是否違法？

我跟對方互告妨礙名譽
結果對方利用告訴補充理由狀不斷不實抹黑我
要讓檢方對我的印象差欲使我被起訴
舉例來說
對方在告訴理由狀中虛構說我跟當初幫我們作筆錄的警察說我揚言就算這次告不程也會不斷監視他，一定要告到他為止。
問題是我沒跟警察說過這樣的話
我打電話質問警察警察也跟我說他沒這樣跟他說
筆錄都有全程錄音錄影，可證明對方惡意說謊抹黑我

但他虛構這個事件並非他提告的事件
是他用來在檢方面前抹黑我，要讓檢方認定我是很惡劣ˇ的人加大檢方起訴我的機率
請問他這樣有沒有違法？
算不算偽造證據？〈明明沒有的事，卻故意虛構？〉
若算，我能馬上對他另提告訴嗎？還是要等到這件官司結束？
