林國政姦殺女童 逃過死刑無期定讞

性侵累犯林國政剛出獄又姦殺雲林縣國二女生葉小妹，一、二審都被判處死刑，最高法院則以「智能低下」為由，改判無期徒刑定讞，引發社會譁然，檢察總長黃世銘提起非常上訴，最高法院以上訴無理由駁回。

駁回理由指出，依「刑事訴訟法」規定，非常上訴僅限於對被告有利，但總長主張改判死刑，是不利被告的非常上訴；另外，上訴案沒有名確指摘判決有違背法令之處所以駁回。
