請問警察可以直接開單嗎?

社會秩序維護法第七十二條第一項第三款「製造噪音或深夜喧嘩,妨害公眾安寧者」規定處新台幣六千元以下罰鍰。 如果接到民眾投訴,警察可以依此法直接開罰嗎? 因為鄰居常常發出噪音,但市環保局量測試在範圍內,後來我就請警察來處理,但是警察說他們只能勸說,如果要開罰需要3戶以上的住戶才能開罰,是真的嗎?
